What is the TIE Card for British Citizens after Brexit?

On 6 July 2020, the Spanish Government introduced a new residence document for British Citizens wanting to secure their residency in Spain under the Withdrawal Agreement. This residence document is the Tarjeta de Identidad de Extranjero (TIE Card).

If you are a British Citizen who moved to Spain before 31 December 2020, you can get your TIE Card in Spain after Brexit under the Withdrawal Agreement if you fall under either of these categories:

You submitted your Spanish residency application after 6 July 2020 and your residency application has been approved (you have resuelto favourable and have been granted a resolución favorable)

You registered your Spanish Residency before 6 July 2020 and have the Certificado de Registro de Ciudadano de la Unión (a green paper residence certificate, A4 or credit card-sized)

If you fall under the 2nd category, according to the Spanish and UK Governments you do not need to get the new TIE Card to protect your rights under the Withdrawal Agreement. Your green residence certificate will remain valid proof of your residency in Spain and your rights under the Withdrawal Agreement (even though it may not explicitly state so). You do however, have the right to apply for the new TIE Card in Spain if you choose to. Both the Spanish and UK Governments advise however, to apply for the TIE Card.

How to get the TIE Card in Spain after Brexit

Book an appointment to apply for your TIE Card

You will have to book and attend an appointment (cita previa) at a police station (Comisaría de la Policía Nacional) in the province where you live in Spain to submit your fingerprints and documents for your TIE Card.

What documents do I need for the TIE Card in Spain after Brexit?

The documents you need for your TIE Card at your appointment differ slightly depending on which category you fall under.

Category 1 - You applied for residency after 6 July 2020 and your application has been approved

  • Appointment confirmation at the Comisaría de la Policía Nacional where you booked your appointment
  • EX 23 Application Form
  • Tax payment form for processing the TIE and confirmation of payment – Tasa modelo 790 Código 012 
  • Passport (original and copy)
  • Passport photo (recent)
  • Empadronamiento
  • Your resolución or residency application approval

Category 2 - You applied for residency before 6 July 2020 and have your green residence certificate

  • Appointment confirmation at the Comisaría de la Policía Nacional where you booked your appointment
  • EX 23 Application Form
  • Tax payment form for processing the TIE and confirmation of payment – Tasa modelo 790 Código 012 
  • Passport (original and copy)
  • Passport photo (recent)
  • Empadronamiento (if you have changed your address since your last residency application)
  • Your Certificado de Registro de Ciudadano de la Unión

What happens after I apply for the TIE Card?

Once you have attended your fingerprinting appointment for your TIE Card you should be given your Resguardo de Solicitud o Renovación de Tarjerta de Extranjero. This document will contain instructions on how to collect your TIE Card. It may take up to 45 days before your TIE Card is ready to be collected. Some provinces may require you to make an appointment to collect your TIE Card.
