How to get Spanish Residency after Brexit

If you are British citizen who moved to Spain before 31 December 2020 and have not secured Spanish Residency, it is not too late. You can still apply for Spanish Residency after Brexit and get your TIE Card in Spain under the Withdrawal Agreement if you can prove that you actually and effectively started living in Spain before 31 December 2020 and that you meet the EU residence requirements on income and healthcare.

Getting Spanish Residency and your TIE card in Spain under the Withdrawal Agreement means that you can continue to live in Spain after Brexit and benefit from the same rights as any EU citizen living in Spain. This includes having the choice to become a permanent resident in Spain.

Is it too late to apply for Spanish Residency after Brexit?

Not yet. As long as you can demonstrate that you actually and effectively started living in Spain before 31 December 2020 and that you meet the EU residence requirments on income and healthcare your rights are protected under the Withdrawal Agreement.

How to get the TIE Card in Spain after Brexit

Getting your TIE Card in Spain involves 3 steps.

Step 1

Submit your application for Spanish Residency to the immigration office
(Oficina De Extranjería) in the province in Spain where you live.

Step 2

Once your Spanish Residency application is approved, book and attend an appointment (in person) at a police station (Comisaría de la Policía Nacional) in the province where you live in Spain to submit your fingerprints and documents for your TIE Card.

Step 3

Collect your TIE Card when it is ready.

What are the requirements for Spanish Residency after Brexit?

 

The requirements for Spanish Residency are listed in the Resolution of July 2, 2020 from the Spanish Government determining the procedure for issuing residence documents for British citizens under the Withdrawal Agreement.

 

EX-20 Application Form

This is the application form specifically for British citizens who want to register their residency in Spain as beneficiaries of the Withdrawal Agreement. It is available online. See our blog article on how to complete the EX-20 application form.

Valid and current UK Passport

If your passport is expired, a copy of the passport and the application for renewal must be provided.

Documentation demonstrating your residence in Spain before 31 December 2020

You have to demonstrate that you started living in Spain before 31 December 2020 to benefit under the terms of the Withdrawal Agreement. The exact requirements may differ in each province. A key requirement, in some provinces (such as Málaga) is to  provide as much evidence as possible that you were actually and effectively living in Spain before 31 December 2020. Documentation demonstrating you meet the EU residence criteria on income and healthcare

The requirements for this are contained in Order PRE/1490/2012, of July 9, 2012 from the Spanish Government and differ depending on whether you are:

Employed by a company registered in Spain

W

Registered as self-employed in Spain

W

Not employed

W

A student studying at an educational institution recognised in Spain

W

Not employed but you receive UK State Pension

How do I submit my residency application in Spain?

You will need to submit your application for Spanish Residency to the immigration office (Oficina De Extranjería) located in the province in Spain where you live. You can submit your residency application in these 3 ways:

In Person

You will have to make an appointment at the Oficina De Extranjería in the province where you live in Spain to submit your residency application in person. The procedure of making an appointment differs among provinces. Some provinces require you to make the appointment by phone or email whilst in other provinces, you can book an appointment online on the public administration website (Sede electronica – Administraciones Públicas). You can find out how to submit your residency application by visiting the website, selecting your province, and following the instructions provided.

Online via Digital Certificate

You can submit your residency application online if have a personal Digital Certificate. See the Agencia Tributaria website on how to get one.

Through a Representative

You can submit your residency application through a legal representative who has an authorised Digital Certificate (such as an immigration lawyer or Gestor) or a third party whom you authorise to submit your application on your behalf using their personal Digital Certificate.

What happens after I submit my Spanish Residency application?

Your application will be decided by the Sub-delegation of the Spanish Government (Subdelegación del Gobierno) located in your province. The Sub-delegation has up to 3 months to make a decision on your application.

You can check the status of your residency application on the public administration website.

If your application has been approved (you have a resuelto favorable) you can proceed to Step 2.

Step 2 –  Apply for the TIE Card in Spain

Once your residency application is approved, you will have to book and attend an appointment at a police station (Comisaría de la Policía Nacional) in the province where you live in Spain to submit your fingerprints and documents for your TIE Card. Step 3 – Collect your TIE Card

Once you have attended your fingerprinting appointment you should be given your Resguardo de Solicitud o Renovación de Tarjerta de Extranjero. This document will contain instructions on how to collect your TIE Card. Some provinces may require you to make an appointment to collect your TIE Card.
